This Indenture Made this 7th day of October in the year of our Lord one thousand Eight hundred and Seventy three between Sarah H. McCRACKEN & Perry McCRACKEN of Aurora County of Jewell and State of Kansas of the first part and Saxon A. WELSTEAD of Jewell City Kansas of the second part Witnesseth That the party of the first part in consideration of the sum of Thirty Six Dollars to them duly paid have bargained and sold and by these presents do grant and convey to the said party of the second part his heirs and assigns all that tract or parcel of land situated in Jewell County and State of Kansas and described as follows: to wit:

Lot No. 5 of the N. E. _ of Sec. 36 T. 4 R. S. West Jewell County Kansas Containing three acres With the appurtenances and all the estate title and interest of the said parties of the first part therein. And the said Sarah H. McCRACKEN & Perry McCRACKEN do hereby covenant and agree, that at the delivery hereof they are the lawful owners of the premises above granted and seized of a good and indefeasible estate of inheritance therein in fee simple and that the same are free and clear of all incumbrances and that they will Warrant And Defend the same in the quiet and peaceable possession of said party of the second part his heirs and assigns forever against the lawful claims of all persons whomsoever.

To all to Whom these Presents shall Come Greeting Whereas W. W. McCRACKEN of Jewell County State of Kansas purchased from the County Treasurer of Jewell County according to the provisions of the act of the Legislature Of The State of Kansas approved February 22nd 1864, entitled an act to provide for the sale of School Lands, Lot No. Five (5) of Section No. Thirty-Six (36) of Township No. Four (4) of Range No. Eight (8) for the sum of Sixty Seven and 50/100 Dollars ($67 50/100) containing three (3) acres, which said tract has been purchased by the said W. W. McCRACKEN and he has paid therefor the full amount of the purchase money and interest as appears from the certificate of the County Clerk of Jewell County.

Now know ye That the State of Kansas in consideration of the premises, and in conformity with the said act of the Legislature Of the State of Kansas in such case made and provided Have Given and Granted and by these presents Do Give and Grant unto the said W. W. McCRACKEN and to his heirs, the said tract above described: To Have and to Hold the same together with all the rights privileges immunities and appurtenances of Whatever nature, thereunto belonging, unto the said W. W. McCRACKEN and to his heirs and assigns forever

In Testimony Whereof I Thomas A. McCRACKEN, of the Same place, of the Second part, witnesseth, that the party of the first part, in consideration of the Sum of Forty Eight Dollars to him duly paid, has bargained and Sold, and by these presents do grant and convey to the Said party of the Second part, her heirs and assigns, all that tract or parcel of land, Situated in Jewell County, State of Kansas, and described as follows, to Wit:

Lot No. (5) Five, of the North East (1/4) one fourth, of Section No. (36) Thirty Six in Township No. (4) Four South, of Range No. (8) Eight-West of the (6th) Sixth Principal Meredian, Containing (3) Three acres.

With all the appurtenances, and all the Estate Title of the Said party of the first part, therein, and the Said W. W. Witnesseth that the said parties of the first part for and in consideration of the sum of Two Hundred Dollars to them in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged does by these presents remise release and Quit Claim unto the said party of the second part and to her heirs and assigns forever all their right title interest claim and demand in and to the following described piece or parcel of land lying and Situate in the County of Jewell and State of Kansas to Wit:

Witnesseth, That the part of the first part, in consideration of the sum of Five Hundred & Forty six and 69/100 Dollars to him duly paid has bargained and sold and by these presents do grant and convey to the said parties of the second part, their heirs and assigns, all that tract or parcel of land, situated in Jewell County and State of Kansas, and described as follows to Wit:

WITNESSETH, That said party of the first part, in consideration of Love and affection and a contract of even date herewith and the sum of One and � Dollars, the receipt of which is hereby acknowledged, does by these presents grant, bargain, sell and convey unto said party of the second part, his heirs and assigns, all the following described real estate, situated in the county of Jewell and State of Kansas, to wit:

Subject to and strictly limited and restricted the reservations hereinafter stated

The North Half of the North West quarter of Section Twenty Eight (28) in Township five (5) South of Range Seven (7) west being Eighty acres more or less; the said grantor however hereby expressly reserving to himself from this grant a life interest and estate in and to the above described real property and the possession use control rents issues and profits thereof for and during the full term and period of his actual life

TO HAVE AND TO HOLD THE SAME. The South Half of the North West quarter of Section Twenty Eight (28) in Township five (5) South of Range Seven (7) west being Eighty acres more or less; the said grantor however hereby expressly reserving to himself from this grant a life interest and estate in and to the above described real property and the possession use control rents issues and profits thereof for and during the full term and period of his actual life

TO HAVE AND TO HOLD THE SAME. Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining, forever; and said Perry McCRACKEN Sr. for himself, heirs, executors or administrators, does hereby promise and agree, to and with said party of the second part, that at the delivery of these presents he is lawfully seized, in his own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above granted and described premises, with the appurtenances; that the same are free, clear, discharged and unencumbered of and from all former and other grants, titles, charges, estates, judgments, taxes, assessments and incumbrances, of what nature or kind soever; and that he will warrant and forever defend the same unto said party of the second part, his heirs and assigns, against said party of the first part, heirs, and all and every person or persons whomsoever, lawfully claiming or to claim the same, subject to the above reservations and restrictions.

BE IT REMEMBERED, That on this 24th day of November, A.D. 1899, before me the undersigned, a Notary Public in and for the county and State aforesaid, came Perry McCRACKEN Sr an unmarried man who is personally known to me to be the same person who executed the within instrument of writing, and such person duly acknowledged the execution of the same.
